Statutory deadlines to remember year-round:

6 weeks from request — LA must decide whether to assess
16 weeks from request — draft EHCP should be issued
20 weeks from request — final EHCP must be issued
15 days from draft — deadline to comment/request changes
Every 12 months — annual review required
2 months from final plan — deadline to appeal to Tribunal

Golden rule: Write about your worst day, not your best. Include specific times, durations, and how much supervision/help was needed. Compare to what a neurotypical child of the same age would need.

SEND35 appeal form (complete, signed)
Mediation certificate (required unless using exemption)
Final EHCP you are appealing (dated, complete)
LA's refusal letter or cessation letter (if applicable)
Your working document showing agreed vs disputed sections

📝 Section 2: Parent statement

Your written case summary — why the current plan is inadequate
Specific paragraphs from CAFA 2014 and SEND Regs 2014 you rely on
Working document cross-references
Requested remedies (exactly what you want changed)

🧾 Section 3: Professional evidence

Educational Psychologist report (LA's or independent)
Speech and Language Therapist report (NHS or private)
Occupational Therapist report (NHS or private)
Paediatrician / CAMHS reports
School SENCO report / APDR cycle evidence
Specialist school reports (if naming an independent school)
Any medical diagnoses or relevant letters

Your written "what I want from this meeting" notes

❓ Questions to ask the SENCO

What support is currently in place? How often, how long?
What assessment has been done so far? What's the next one?
Who delivers the support? What are their qualifications?
What outcomes are we working towards? How are they measured?
When will we review progress? What does "progress" look like?
What external support have you requested (EP, SALT, OT)?
Is my child on the waiting list for any assessments? For how long?
If this isn't enough, when do we move to EHCP request?

✍️ What to ensure is written down

Specific targets / outcomes being worked on
What support is being provided (name, frequency, duration)
Who is responsible for each action
Review date (should be within the term)
Any new assessments being requested
Parent concerns recorded as stated

🚩 Red flags — when to escalate to EHCP

SEN Support has been in place for 2+ terms with no progress
Multiple professionals have been involved (EP, SALT, OT) without coordination
Child's needs exceed what mainstream reasonably provides
Child is being excluded or at risk of exclusion
School says they can't provide what's needed from their budget
Child's attendance is dropping due to unmet needs
